Terms of Service

Terms governing your use of Synth Explorer.

These Terms of Service ("Terms") govern your access to and use of Synth Explorer, including the website, web application, free features, paid features, and related services we make available (collectively, the "Service").

By creating an account, clicking a sign-in or invite link, using the Service, or purchasing access to paid features, you agree to these Terms.

1. Who these Terms apply to

When these Terms refer to "Synth Explorer," "we," "our," or "us," they refer to the operator of the Synth Explorer service.

When these Terms refer to "you" or "your," they refer to the person using the Service or, if applicable, the company or organization on whose behalf that person is using the Service.

2. The Service

Synth Explorer is a browser-based sound editor and librarian designed for supported synthesizers, including the Sequential Prophet-6 and Oberheim OB-6. Features may include:

3. Account terms

  1. You must provide accurate account information and keep it up to date.
  2. You are responsible for maintaining the security of your account and any sign-in links, devices, browsers, or sessions used to access it.
  3. You are responsible for all activity that occurs under your account.
  4. You may not use the Service for unlawful purposes, to interfere with the Service, to attempt unauthorized access, or to abuse, disrupt, reverse engineer, scrape, or overload the Service.
  5. We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms, created risk for the Service or other users, or used the Service in a fraudulent, abusive, or unlawful way.

4. Free and paid access

  1. Synth Explorer may offer both free and paid access levels.
  2. Free-tier features may be limited by functionality, usage, storage, or other restrictions that we define from time to time.
  3. Paid access currently refers to a one-time purchase that unlocks additional features for your account, unless we clearly state otherwise at the time of purchase.
  4. Pricing may change for future purchases. A price change does not retroactively alter a completed one-time purchase.

5. Payments

  1. Paid purchases are processed by third-party payment providers, including Stripe.
  2. By purchasing paid access, you agree to provide valid and complete payment information and authorize the applicable payment processor to charge the amount shown at checkout.
  3. Your purchase is subject to any additional purchase, checkout, refund, or payment terms presented at checkout or linked from checkout.
  4. Taxes, if applicable, may be added at checkout.

6. Refunds

Refund requests are governed by our Refund Policy. Please review that policy before making a purchase.

7. Your content and data

  1. You retain ownership of the program data, names, categories, notes, uploads, exports, and other content you create, import, store, or manage through the Service ("User Content").
  2. You grant us a limited, non-exclusive right to host, process, transmit, back up, and otherwise use User Content only as needed to operate, maintain, secure, and improve the Service.
  3. You represent that you have the rights necessary to use any User Content with the Service.
  4. You are responsible for keeping your own backups of important data. Synth program data, library changes, browser storage, and backups may be lost due to browser clearing, device issues, import/export mistakes, sync issues, or service failures.

8. Connected hardware and third-party services

  1. The Service may interact with supported hardware, Web MIDI, browsers, local storage, Supabase, Stripe, and other third-party services or technologies.
  2. We do not guarantee that every browser, operating system, MIDI device, cable, adapter, or synthesizer setup will work correctly.
  3. You are responsible for verifying edits, backups, transfers, and writes before relying on them in a live or irreversible workflow.
  4. We are not responsible for damage, lost sounds, corrupted patches, or other losses resulting from hardware communication errors, unsupported workflows, user error, or third-party failures.

The Service, including its software, design, branding, logos, visual elements, text, and other original materials, is owned by Synth Explorer or its licensors and is protected by applicable intellectual property laws.

These Terms do not give you any ownership rights in the Service itself. Except as allowed by law, you may not copy, modify, distribute, reverse engineer, or create derivative works from the Service without our prior written permission.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and handle personal information.

12. Availability and changes

  1. We may change, suspend, or discontinue any part of the Service at any time.
  2. We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
  3. We may release updates, fixes, and changes without prior notice.

13. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

To the maximum extent permitted by law, Synth Explorer and its operators, affiliates, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, business, goodwill, or use, arising out of or related to the Service.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us for the Service during the 12 months before the event giving rise to the claim, or $100 USD, whichever is greater.

15. Termination

You may stop using the Service at any time.

We may suspend or terminate your access at any time if we reasonably believe you have violated these Terms, created legal exposure, or harmed the Service or other users.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, payment-related provisions, and dispute-related provisions.

16. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we may update the date above and may take additional steps to notify users where appropriate. By continuing to use the Service after updated Terms take effect, you agree to the revised Terms.
